Another game changing law benefiting the people has been signed by President Duterte—the new SSS Law.

Salient provisions of the new SSS Law include the compulsory coverage of all overseas Filipino workers, both land-and-sea-based. For land-based OFWs, the Department of Foreign Affairs and the Department of Labor and Employment and all their agencies involved in deploying OFWs for employment abroad are mandated to negotiate bilateral social security and labor agreements with the OFWs’ host countries to ensure that the employers of land-based OFWs pay the required SSS contributions.

Duterte signs the new SSS Law

We want to develop a culture of work, save, invest, prosper. The law envisions a benefits-based system—what you invest is what you get; no investment, no benefit.

This is a game changing law. Ngayon mas malaki ang savings ng mga tao, mas malaki ang makukuha nila pag lampas nila sa threshold ng 12% at 20 years. Hybrid na - meron silang defined benefits at saka defined contribution.

The law does not promise an abundance of wealth. Ang sinasabi dito ay pagka-nagkaroon sila ng aberya sa kanilang buhay, meron silang panghahawakan. Meron silang masasandalan. Meron silang lifeline that they, themselves, created. Na sila mismo ang nag-contribute with other Filipinos towards the benefit of their own posterity.

Sample Portfolios and Cover Designs for RPMS SY 2018-2019

According to DepEd, RPMS or the Results-Based Performance Management System is being implemented in consonance with the Civil Service Commission’s (CSC) Strategic Performance Management System (SPMS) (Sample RPMS Portfolios and Covers Design Templates below). It follows the four-phase cycle of SPMS prescribed in CSC Memorandum Circular No. 6, s. 2012 and aims to ensure that both teaching and non-teaching personnel focus work efforts toward achieving the Department’s vision, mission, values, and strategic priorities. As stipulated in DepEd Order No. 2, s. 2015 (Guidelines on the Establishment and Implementation of RPMS in DepEd), RPMS is a systemic mechanism to manage, monitor and measure performance, and identify human resource and organizational development needs to enable continuous work improvement and individual growth.

As a learner-centered institution, the Department of Education (DepEd) is committed to continuously improve itself to better serve the Filipino learners and the community. The adoption of the SPMS in DepEd strengthens the culture of performance and accountability in the agency, with the DepEd’s mandate, vision and mission at its core.

There is a need to concretize the linkage between the organizational thrusts and the performance management system. It is important to ensure organizational effectiveness and track individual improvement and efficiency by cascading the institutional accountabilities to the various levels, units and individual personnel, as anchored on the establishment of a rational and factual basis for performance targets and measures. Finally, it is necessary to link the SPMS with other systems relating to human resources and to ensure adherence to the principle of performance-based tenure and incentives.

The RPMS shall align the performance targets and accomplishments with the Department’s mandate, vision, mission and strategic goals. It shall ensure 100% results orientation vis-a-vis the planned targets. On the other hand, the ratee’s demonstration of the required competencies shall be monitored for developmental purposes only.

The RPMS cycle shall cover performance for one whole year. All school-based personnel shall follow a performance cycle starting in April of the current year and ending in March of the following year; while non school-based personnel shall follow a performance cycle starting in January and ending in December.

The performance planning and commitment shall be done prior to the beginning of the performance cycle; while the performance monitoring and coaching shall take place immediately after Phase I, and continue throughout the performance cycle. The performance review and evaluation, as well as the performance rewarding and development planning shall be done at the end of the performance cycle.

No Political Candidates in School Graduations

The Commission on Elections (Comelec) urged government agencies and public schools to steer clear of inviting to their events candidates who are running in the May midterm election.

Comelec spokesperson James Jimenez said on Friday that while there was no specific provision prohibiting candidates from being invited to speak in functions or in graduation ceremonies, it would be prudent to avoid tapping them so these agencies and schools would not be accused of engaging in partisan activities.
“If you were to force your staff to listen to someone speak and be political at that event then you might be imposing your political views on them. It’s the appearance of impropriety that we want to avoid,” Jimenez said.

The Comelec and the Presidential Anti-Corruption Commission have also called on the public to report candidates using government resources for their campaign.

As this developed, the Comelec warned on Friday 40 senatorial candidates who had not removed their posters that violate regulations on campaign materials.

“We are just informing them of our guidelines and giving them a warning to comply,” Jimenez said.


List of violators

Included in the list were administration candidates Freddie Aguilar, Sonny Angara, Pia Cayetano, JV Ejercito, Jinggoy Estrada, Zajid Mangudadatu, Koko Pimentel, Francis Tolentino and Cynthia Villar.

Also on the list were opposition candidates Gary Alejano, Bam Aquino, Chel Diokno, Florin Hilbay, Romy Macalintal and Lorenzo Tañada.

Also listed were Raffy Alunan, Nancy Binay, Glenn Chong, Neri Colmenares, Larry Gadon, Conrado Generoso, Lito Lapid, Sonny Matula, Allan Montaño, Serge Osmeña, Grace Poe, Ibrahim Albani, Richard Alfajora, Ernesto Arellano, Marcelino Arias, Bernard Austria, Edmundo Casiño, Leborio Jangao, Rodolfo Javellana, Emily Mallillin, Faisal Mangondato, Luther Meniano, Willie Ong, Danilo Roleda and Antonio Valdes.

But one aspirant balked at his inclusion in the Comelec list of violators.

2019 DepEd End of School Year Rites and Graduation Theme

2019 DepEd Official Graduation Theme. The Philippine Department of Education has just released the 2019 official theme for graduation rites across all public and private schools in the Philippines.


DepEd Order No. 002, s. 2019 (School Year 2018-2019 K to 12 Basic Education Program End of School Year Rites). The following are the highlights of the released department order dated February 18, 2019:
(1) For School Year (SY) 2018-2019, the Department of Education (DepEd) announces the conduct of the following End-of-School-Year (EOSY) Rites:
  • Kindergarten: Moving Up or Completion Ceremony
  • Grade 6: Graduation Ceremony
  • Grade 10: Moving Up or Completion Ceremony
  • Grade 12: Graduation Ceremony
(2) The 2019 ceremonies shall focus on the theme Pagkakaisa sa Pagkakaiba-iba: Kalidad na Edukasyon para sa Lahat (Unity in Diversity: Quality Education for All). Schools, divisions, or regions may translate the theme into their respective Mother Tongues. This theme highlights the role of K to 12 Basic Education Program in developing an educated society where the challenges and benefits of diversity are embraced and welcomed by every Filipino.

(3) As announced in Enclosure No. 2 of DepEd Order (DO) No. 25, s. 2018 entitled School Calendar for School Year 2018-2019, the end of school year rites should be scheduled not earlier than April 1, 2019 but not later than April 5, 2019. Schools, divisions, or regions with an extended school year will have to be guided by their approved revised school calendar.
(4) In line with the government’s austerity program, DepEd reiterates the following policies:
  • Graduation rites should be simple but meaningful which encourage civil rights, a sense of community, and personal responsibility. While these rites mark a milestone in the life of the learners, these should be conducted without excessive spending, extravagant attire, or extraordinary venue;
  • Moving Up or Closing Ceremonies should be simple involving only the learners, their parents and the school; and,
  • Nonacademic projects such as attendance to field trips, film showing, Junior-Senior promenade, and other school events should not be imposed as requirements for graduation or completion.
(5) The use of the enclosed completion certificate and diploma templates are as follows:
  • For private elementary and secondary schools, technical and vocational institutions (TVIs), and higher education institutions (HEIs), including state universities and colleges (SUCs) and local universities and colleges (LUCs): The use of the enclosed completion certificate and diploma templates is optional. The signature of the school head is required, while the signature of the schools division superintendent is not required.
  • For public elementary and secondary schools: The use of the enclosed completion certificate and diploma templates is required.
(6) Awarding of honors to learners from Grades 1 to 12 shall follow the guidelines in DO 36, s. 2016 entitled Policy Guidelines on Awards and Recognition for the K to 12 Basic Education Program.
(7) Further, the EOSY rites and moving up or completion ceremony shall be conducted in an appropriate solemn ceremony befitting the learners and their parents and shall not be used as a political forum. DepEd reiterates the strict compliance with DO 48, s. 2018 entitled Prohibition of Electioneering and Partisan Political Activity.

With a short time for maternity leave for teachers, the health and welfare of the newborn and the nursing mother and the quality of education for their students may suffer.

The current maternity leave is extremely inadequate and considered among one of the shortest maternity leave in the whole world as per the International Labor Organization (ILO) convention. This measure further assures the security of tenure of female workers and emphasizes that maternity leave shall not be used as basis for demotion in employment or termination.

WalangPasok: February 25 is special non-working holiday

Under Proclamation No.269, signed by President Duterte on July 17, 2017, February 25, the 32nd anniversary of the EDSA Revolution, is a special (non-working) day.

Labor Secretary Silvestre Bello 3rd said on Monday the “no work, no pay” rule applies on all special non-working holidays specified by Proclamation No.269.

Under Proclamation No.269, signed by President Duterte on July 17, 2017, February 25, the 32nd anniversary of the EDSA Revolution, is a special (non-working) day.


Bello pointed out though that the “no work, no pay” principle is not applicable if there is an existing favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.

Bello stressed that proper observance of pay rules on regular holidays and special non-working days is good for business as it will lead to more productive and competent employees.

The proper pay rules to be observed for the special (non-working) day are as follows:

For work done during the special day, the workers shall be paid an additional 30 percent of their daily rate on the first eight hours of work. The “daily rate x 130% plus COLA” scheme will be observed.


For work done in excess of eight hours (overtime work), the workers will be paid an additional 30 percent of their hourly rate on said day. The computation will be: hourly rate of the basic daily wage x 130% x 130% x number of hours worked.

For work done during a special day that also falls on the workers’ rest day, they shall be paid an additional 50 percent of their daily rate on the first eight hours of work, thus, the “daily rate x 150% + COLA” computation will apply.

For work done in excess of eight hours (overtime work) during a special day that also falls on the workers’ rest day, they shall be paid an additional 30 percent of their hourly rate on said day, or a computation of “hourly rate of the basic daily wage x 150% x 130% x number of hours worked.”


Class Suspensions on February 18,19, 26, 27, 2019

The Malacañang Palace has declared four additions special non-working holidays in some selected areas due to several important events.
Palace released four proclamations declaring February 18, 19, 26 and 27, 2019 as special non-working holidays.
Executive Secretary Salvador Medialdea signed the four new proclamations with the authority bestowed by President Rodrigo Duterte.

Here is the list of four new special holidays in some areas:
  • February 18, 2019 (Monday) – Class suspensions have been declared in the City of Bayawan in Negros Oriental in celebration of Tawo-Tawo Festival that reflects to the culture of the city based on Proclamation No.667.
  • February 19, 2019 (Tuesday) – a special non-working holiday was declared in Bago, Negros Occidental in celebration of its 53rd Charter Anniversary.
  • February 26, 2019 (Tuesday) – cancellation of classes was  proclaimed in the City of Zamboanga due to the celebration of its  82nd Charter Anniversary.
  • February 27, 2019 (Wednesday) – a special non-working holiday has been declared in General Santos City in celebration of the 30th Kalilangan Festival and 80th Founding Anniversary of the city based on Proclamation No. 670

Statement on the proposed “no vaccination, no enrollment” policy

PASIG CITY, February 22, 2019 – In view of the rising number of measles cases in the country, the Department of Education (DepEd) is studying the proposal of the Department of Health (DOH) to implement a “no vaccination, no enrollment” policy in public schools.
As much as there is a growing need to reinvigorate the campaign for the importance of vaccination, Education Secretary Leonor Magtolis Briones emphasizes that the proposed policy must take into consideration the human rights of learners, especially their access to quality basic education.

While DepEd is looking into different ways to regain the confidence of parents in immunization, the agency has made commitments with DOH in ensuring that the learners are protected. Among these are to:


• Develop consent form and evaluation form, which will categorize learners as “vaccinated,” “doubtful,” and “not vaccinated”
• Verify school records and vaccination cards
• Gather and share data on the number of learners affected with measles
• Coordinate with health center staff on learners who are absent and whose parents did not give consent during vaccination
• Follow up on learners who did not receive vaccination and those who opted to be inoculated by private practitioner
• Review and explore the strengthening of Executive Order No. 663, series 2007

Learners, parents, teaching and non-academic personnel, and stakeholders may rest assured that the Department is working closely with DOH in monitoring measles cases and in strengthening efforts to combat the disease.

CSC Rules on Leave Handbook

Government employees are expected to perform their duties and responsibilities effectively and efficiently. The government in return, acknowledges hard work and grants benefits such as leave privileges.

The Omnibus Rules on Leave consolidates & updates all laws & administrative issuances relative to leave Administration in government sector.

Non-Teaching personnel in DepEd are entitled to 15 days vacation and 15 days sick leave annually.
On the other hand, Teachers engaged in actual classroom teaching are under Teacher’s Leave basis.
The subsequent paragraphs will expound everything you should know about Teacher’s Leave.

Who is a Teacher? 
The term “teacher” refers to teachers who do not have to report for classes during Christmas and long summer vacation and still be entitled to their regular compensation as defined under DepEd Order No. 53, s. 2003.

On Teacher’s Leave. 
Teachers are not entitled to the usual vacation and sick leave credits but to Proportional Vacation Pay (PVP). The total PVP that shall be earned by teachers shall be based by the computation to be provided by DepEd every school year. A teacher who has rendered continuous service in a school year without incurring absences without pay of not more than 1½ days is entitled to the total PVP earned from the number of summer and Christmas vacation days as determined by the DepEd.(sec. 6 of CSC MC No. 41, s. 1998 as amended by CSC MC No. 9, s. 2012)

THE CIVIL Service Commission (CSC) has issued a resolution granting a five-day special emergency leave for government employees directly affected by natural calamities or disasters.

“With the increasing risks brought about by climate change and global warming, the Commission saw it necessary to offer assistance to state workers affected by natural calamities in the form of special leave. We hope that this would give affected employees respite and ample time to recover,” said CSC Chair Francisco T. Duque III.

In CSC Resolution No. 1200289 issued on February 8, state workers in officially-declared calamity areas may avail of the special emergency leave for five straight working days or on staggered basis. Said special leave is separate and will not be deducted from the employee’s leave credits, and may be availed of within 30 days from the first day of calamity declaration by proper government authorities.

A natural calamity or disaster may include “earthquakes, flooding, volcanic eruption and landslide that have profound environmental effect and/or human loss and frequently cause financial loss”.

The leave may be used by employees stranded in affected areas, for urgent repair and clean-up of damaged house, for recovery from disease/illness, or for caring for immediate family members affected by natural calamity.

The CSC policy orders heads of offices to take full responsibility in granting special emergency leave and in verifying the employee’s eligibility to avail of such.

Vacation Service Credits. 
Sec. 9, MC 41,s.1998 defines Vacation Service Credits as the leave credits earned for services rendered on activities, during summer or Christmas vacation, as authorized by proper authority. These vacation service credits are used to offset absences of a teacher due to illness or to offset proportional deduction in vacation salary due to absences for personal reasons or late appointment.

When funds are not available for the grant of additional compensation or overtime pay, VACATION SERVICE CREDITS may be granted for services rendered beyond the required working hours during school days, which is exclusive of the 15 days limitation under DepEd Order No. 53, s. 2003.

Request for Service Credits accompanied by Accomplishment Report and Daily Time Record (DTR) shall be accomplished and submitted after completion of vacation service. Vacation Service Credit shall not be granted for services rendered without previous authority.

Teachers who are designated to perform non-teaching functions and who render the same hours of service as other employees shall be entitled to vacation and sick leave as provided for under CSC MC No. 41, s. 1998.

School/District Property Custodians.
Teachers designated on part-time basis as Property Custodians and who are required to render services during the summer vacation to conduct property inventory after the closing and before the opening of classes shall likewise be granted Vacation Service Credits of not more than 15 days, also exclusive of the 15 days limitation.

ALS Mobile Teachers. 
DepEd Order No. 64, s. 2011 provides Equal Opportunities and Standard Implementation of DepEd Policies for the ALS Implementors. The ALS Teacher, better known as Mobile Teacher, and District ALS Coordinator (DALSC) follows a flexible teaching schedule without summer vacation and different teaching hours to meet the learning needs of the ALS learners, the Mobile Teacher/DALSC is entitled to earn leave credits and avail of the privilege of monetization of leave credits.

Other Leave Benefits. Other Leave benefits of teachers such as Study Leave and Indefinite Sick Leave are covered by Section 24 and 25 of RA 4670 (Magna Carta for Public School Teachers).

Study Leave.
Study Leave of not exceeding one (1) school year may be granted to teachers who have rendered at least seven (7) years in service. A teacher shall be entitled to at least 65% of his monthly salary provided he takes regular study load & passes at least 75% of the courses. Study leave of more than one (1) year shall be permitted by the DepEd Secretary but without compensation.

Indefinite Leave
Indefinite Leave is granted to Teachers when the nature of the illness demands a long treatment that will exceed one year at the least. A teacher applying for indefinite sick leave of absence should submit a Medical Certificate (CS Form 41) and CS Form 6 (Application for Leave) stating the approximate maximum number of days he expects to be on leave, subject to change as the government physician may recommend.

Rehabilitation Leave
Rehabilitation leave is a leave privilege granted to allow qualified government officials and employees to recuperate from wounds or injuries sustained while in the performance of duties.

Performance of duty means situations where the employee is already at work. It may also cover situations where the employee or official meets an accident while engaged in activities inherent to his/her work including being on official travel, official business outside work station, authorized overtime, detail or special assignment. Injuries from accidents that occurred while going to work and going home from work may be considered sustained while in the performance of official duties.

No Salary Increase for Teachers this February 2019

Public school teachers and employees from the Alliance of Concerned Teachers (ACT) scored the Duterte administration for failing to still effect the 4th tranche of the salary adjustment on the month of February despite the ratified status of the 2019 budget. Salaries of public school teachers are released every 21st of the month and they were dismayed to find that their February pay still does not reflect the increase.

Previous reports quoted Budget Secretary Benjamin Diokno’s promise that the pay hike based on Executive Order 201 of then President Aquino will be given by February.

“Sec. Diokno earlier blames the lawmakers for the delay of the pay hike due to the latter’s failure to pass the 2019 budget. The legislators has ratified the national budget two weeks ago, what could be Diokno’s excuse now? Clearly, the problem is with the executive,” said Joselyn Martinez, ACT Philippines Chairperson asked.

The ratified 2019 spending program currently awaits President Duterte’s signature.

“Napakaliit na nga lang, huling-huli pa. There seems to be a total lack of urgency among our officials, which just goes to show how out of touch they are with the everyday struggles of ordinary Filipinos,” lamented Joselyn Martinez, ACT National Chairperson.

The fourth and last installment of pay hike will effect a P575-increase on the monthly salaries of entry-level teachers.

Martinez added that the President has been signing laws ‘left and right’ in the previous days, but the budget is yet to be approved.

“Obviously, P575 will do very little in salvaging us from the difficulties we are in. That’s why we ask Pres. Duterte and Sec. Diokno: what are you doing to make good on the promised pay hike for teachers this year?” questioned Martinez.

She lamented that the ratified 2019 budget did not include the salary increase promise and as such, “the government must give us an update on their efforts to realize this, or if they are doing anything about it at all,” pressed Martinez.

The group reiterates their demand for a significant pay hike of at least Php30,000 basic pay for Teacher 1, Php31,000 for Instructor 1, and Php16,000 for salary grade 1 employees. They also call for the administration to effect an additional Php3,000 to the Php2,000 Personnel Economic Relief Allowance (PERA).

    At the beginning of the school year, the class adviser shall collect supporting documents to establish the identity of each learner assigned to his/her advisory class.

    As the school year proceeds, all the needed documents/reports/forms shall be accomplished cordially and be prepared before the checking forms is conducted at the year end. The School Checking Committee is expected to conduct a pre-checking activity involving the thorough review of all learner’s records for all classes.

    The SCC is also tasked to communicate with the DCC regarding the schedule for the checking of forms and other necessary arrangements.

    MANILA, Philippines – The Department of Education (DepEd) is expected to release results of the December 2018 Principals' Test formerly known as National Qualifying Examination for School Heads (NQESH) between April and May 2019 or 5-6 months after the exam. The complete list of passers and top 10 (topnotchers) are available on this page as announced online.

    DepEd through the Bureau of Human Resource and Organizational Development (BHROD) and the Quality Assurance Divisions of the Regional Offices (RO-QAD) administered the 2018 Principals' Test on December 9 in at least 26 exam centers nationwide.

    The administration of the test is DepEd's mechanism to select school heads in the public education sector - a qualifying process for interested applicants to Principal I positions. It is being implemented in coordination with the Schools Divisions Offices (DOs) through the Regional Offices (ROs).

    EXAM COVERAGE

    The test covered the competencies anchored on the domains of the National Competency-Based Standards for School Heads (NCBSSH) stipulated in DO 32, s. 2010 entitled National Adoption and Implementation of the National Competency-Based Standards for School Heads.

    It includes the following: School Leader, Instructional Leader and School Manager. As such, the seven domains of the NCBSSH were clustered into three, namely:

    a. Cluster Domain 1: School Leader
    • School Leadership
    • Personal and Professional Attributes and Interpersonal Effectiveness
    b. Cluster Domain 2: Instructional Leader
    • Instructional Leadership
    • Creating Student Centered Learning Climate
    c. Cluster Domain 3: School Manager
    • Human Resource Management and Professional Development
    • Parent Involvement and Community Partnership
    • School Management and Operations
    In order to pass the test, takers must obtain a rating of at least 70% in each of the clustered domains.
    RELEASE OF RESULTS

    DepEd said that official results will be released through a Memorandum followed by the distribution of printed Certificates of Rating (CoR) to all test takers through the RO-QAD.

    Takers may expect results to come out around April to May 2018. Any development on the checking of test papers or unforessen circumstances may change the probable release date.

    PREVIOUS EXAMINATION

    In the December 2017 Principals' Test, results were released in 5-6 months after the exam. Only 5,111 out of 20,653 (24.75%) passed the exam. Grant B. Gubatan from Region 1 and Rhoda O. Dela Cruz from Region 4A tied on highest spot.

    In the April 2017 (2016 Principals' test), results were announced after 5 months. A total of 388 examinees out of thousands aspiring school heads successfully hurdled the exams. The top 10 passers list was led by Christian N. Sango of Region XI.

    In the October 2015 exam, 2,195 out of nearly 19,000 takers passed the exams. Results were out online in less than 3 months. Erwin John Santos from Region 3 and Garry Vacunawa from Region 8 led the passers.

    Public school teachers to receive special allowance on World Teachers’ Day

    Senator Loren Legarda announced that public school teachers can expect a “special allowance” on World Teachers’ Day.

    The Senate bicameral panel has allotted as much as P800 million in the 2019 national budget, as “special allowance” or incentives to government teachers. The budget is still on top of the expected chalk allowance increase.

    Senator Loren Legarda, chairwoman of the bicameral conference panel of the Upper House, made the announcement on Saturday. She added that teachers need to be rewarded and recognized for their contributions to society.

    Legarda said, “We cannot overemphasize the importance of our teachers. They are our unsung heroes who dedicate their lives to mold the minds of the Filipino youth. They also do other duties for our country by assisting during the elections and aid the Philippine Statistics Authority (PSA) in gathering data from households across the country.”

    The senator said that the special allowance of P1,000 will be distributed to teachers every World Teachers’ Day (October 5) as an incentive or honorarium.

    Legarda added, “We must advance the social, economic, and professional status of our teachers, who face day-to-day challenges in our education system. It is only fair that the men and women behind our successes receive the benefits and incentives they deserve.”

    Legarda has been responsible for pushing the increase of teachers’ chalk allowance since 2015. From P1,000 in 2015, chalk allowance has increased to P3,500 in 2018. Lawmakers are eyeing to increase it to as much as P5,000.
