    DBM releases updated rules and guidelines for the grant of the Year- End Bonus and Cash Gift

    The Year-End Bonus equivalent to one (1) month basic pay as of October 31 and Cash Gift of P5,000 shall be given to entitled government personnel not earlier than November 15 of the current  year, subject to the following conditions:

    =6.1.1 Personnel has rendered at least a total or an aggregate of four (4) months of service from January 1 to October 31 of the  current year; and
    =6.1.2 Personnel remains to be in the government service as of October 31 of the same year.

    Rules and Regulations on the Grant of theMid-Year Bonus for FY 2016




    The Department of Budget and Management has issued the specific guidelines on the grant of the P31 billion Mid-Year Bonus of government employees mandated under Executive Order No. 201. The majority of government employees will receive their bonus tax-free, according to Budget Secretary Florencio B. Abad.
    “Eight in every ten civilian personnel will receive their mid-year bonus in full, or tax-free under Republic Act 10653, which provides that gross benefits such as the 13th month pay and other benefits not exceeding P82,000 shall be tax exempt,” Abad said.
    “These means the majority of civilian personnel will take home their mid-year bonus in full. They are the 970,943 civilian employees belonging to Salary Grades 1 to 16,” Abad added.
    Executive Order No. 201 approved by President Aquino on February 19, 2016 provides that a Mid-Year Bonus equivalent to one month basic salary as of May 15 shall be granted to all positions for civilian personnel as well as military and uniformed personnel (MUP).
    Budget Circular 2016-3 provides the rules and regulations on the grant of said bonus to all civilian positions whether regular, casual, or contractual in nature, appointive or elective, full-time or part time, as well as MUP. The bonus shall be given not earlier than May 15, 2016.
    Funding requirement for regular personnel of national government agencies shall be charged against MPBF based on the number of filled positions in the Government Manpower Information System as of April 30, 2016.  The requirement for casuals and contractual personnel shall be charged against the agency lump sum appropriation from which the salaries of these employees are drawn.
    To be entitled, an employee must have rendered at least a total or an aggregate of 4 months of service from July 1, 2015 to May 15, 2016, obtained at least a satisfactory performance rating in the immediately preceding period, and should still be in the service as of May 15.
    Those with less than four months of service, or those that are no longer in the service as of May 15, shall not be entitled to the bonus.
    For GOCCs, the governing board shall determine the grant of the bonus charged against approved corporate operating budgets. If funds are insufficient, they may grant at lower rates but at uniform percentage of the basic monthly salary as of May 15.
    For LGUs, the Sanggunian shall determine the grant of the bonus charged against, and subject to the Personnel Services limitation in, LGU budgets. They may also grant at lower rates but at uniform percentage of the basic monthly salary as of May 15, if funds are insufficient.

    DOF supports bill exempting P30-K monthly income from taxes

    MANILA, Philippines - The Department of Finance (DOF) has expressed support for the proposal of Navotas Rep. Tobias Tiangco to exempt income of up to P30,000 a month or P360,000 a year from taxation.

    Tiangco said yesterday DOF Undersecretary Karl Kendrich Chua supported his bill during a hearing of the House of Representatives Committee on Ways and Means Wednesday.
    In fact, he said Chua told the committee that their proposal hews closely with his bill.
    “My office is ready and willing to work with the DOF to ensure the swift passage of the tax reform program. It is high time our taxpayers enjoy their hard-earned money,” he said.
    “We have the same goal in mind: to remove income tax for low-income earners and reduce it for other workers and even corporate executives,” he stressed.
    Aside from exempting income of up to P30,000 a month from taxation, Tiangco is proposing to adjust the income tax brackets to approximate current consumer prices.
    “The current system of taxation is severely outdated and is no longer fair and equitable. It is a fact that Congress determined the tax brackets now provided under the law as early as 1986. They have remained unchanged to date. On the other hand, the increase in inflation has gone up as high as 300 percent,” he said.
    “With the current income tax brackets, the Philippines effectively imposes the highest personal income tax in the whole ASEAN (Association of Southeast Asian Nations) region,” he said.
    Even before President Duterte assumed office last June 30, then finance secretary-designate Carlos Dominguez advocated the reduction of individual and corporate income taxes.
    However, nearly three months into the new administration, Dominguez has not presented concrete proposals to the House, where tax measures must emanate.
    Two weeks ago, he announced that to recoup billions in revenues expected to be lost from income tax cuts, the DOF would have to push for new taxes, like imposing a P6 per liter levy on diesel, kerosene and cooking gas, and increasing the excise tax on gasoline from less than P5 per liter to P10.
    Some tax exemptions for senior citizens would also be withdrawn.

    DOF's proposed tax reform packages filed

    In the DOF’s proposed tax measure filed to the House of Representatives ways and means committee, the unnumbered bill seeks to amend the National Internal Revenue Code to impose two tax schedules in 2018 and 2019.

    The DOF proposed tax schedule for 2018 is:

    • Not over P250,000 – zero percent
    • Over P250,000 but not over P400,000 – 20 percent of the excess over P250,000
    • Over P400,000 but not over P800,000 – P30,000 + 25 percent of the excess over P400,000
    • Over P800,000 but not over P2 million – P130,000 + 30 percent of the excess over P800,000
    • Over P2 million but not over P5 million – P490,000 + 32 percent of the excess over P2 million
    • Over P5 million – P1.45 million + 35 percent of the excess over P5 million
    • In the DOF’s proposed tax schedule for 2019, the tax for personal income would further go down:
    • Not over P250,000 – zero percent
    • Over P250,000 but not over P400,000 – 15 percent of the excess over P250,000
    • Over P400,000 but not over P800,000 – P22,500 + 20 percent of the excess over P400,000
    • Over P800,000 but not over P2 million – P102,500 + 25 percent of the excess over P800,000
    • Over P2 million but not over P5 million – P402,500 + 30 percent of the excess over P2 million
    • Over P5 million – P1,302,500 + 35 percent of the excess over P5 million

    The bill also repealed the tax exemption on 13th month pay and other benefits not exceeding P82,000 in the public and private sector.

    Meanwhile, the bill would increase the excise taxes on petroleum products, including imposing new taxes on petroleum products that were previously not imposed with excise tax:


    • Lubricating oils and greases – P10 per liter (from P4.5)
    • Processed gas – P6 per liter (from P0.05)
    • Waxes and Petrolatum – P10 per kilogram (from P3.5)
    • Denatured alcohol – P6 per liter (from P0.05)
    • Naptha, regular gasoline – P10 per liter (from P4.35)
    • Leaded premium gasoline – P10 per liter (from P5.35)
    • Unleaded premium gasoline – P10 per liter (from P4.35)
    • Aviation turbo jet fuel – P10 per liter (from P3.67)
    • Kerosene – P6 per liter (from zero)
    • Diesel fuel oil – P6 per liter (from zero)
    • Liquefied petroleum gas – P6 per liter (from zero)
    • Asphalts – P6 per kilogram (from P0.56)
    • Bunker fuel oil – P6 per liter (from zero)


    The DOF’s proposed bill also seeks to repeal the laws that allowed senior citizens and PWDs VAT exemption—Section 4 of the Expanded Senior Citizens Act, and Section 32(a) of the Magna Carta for Persons with Disability.

    DepEd to hire 13,200 personnel for nonteaching jobs in schools

    By next year, public school teachers can expect lesser administrative workload with the hiring of more than 13,000 personnel to do non-teaching jobs in schools nationwide.

    The Department of Education (DepEd) disclosed the good news yesterday to thousands of teachers who gathered at the Cuneta Astrodome in Pasay City for the kick-off celebration of World Teachers’ Day on Oct. 5.


    In his keynote speech, Education Undersecretary Jesus Mateo announced that the lower House has approved the agency’s proposed 2017 budget amounting to P567 billion, which is 34 percent bigger than this year’s allocation.


    “The substantial part of the budget will not only address critical resources but also other requirements,” Mateo told the teachers. “You’ve been telling us that you lack support staff, so now the DepEd has started creating non-teaching staff for schools but this will be done gradually.”

    In an interview, Mateo said P4 billion of the P567-billion budget has been earmarked for the hiring of 13,266 personnel to handle non-teaching jobs such as financial and administrative tasks. A big bulk of these non-teaching employees will be assigned to senior high schools, he said.

    The number is a huge jump from the 2,500 non-teaching items the agency opened in 2015 and 11,000 this year, noted Mateo.

    “The number was small in the previous years because our fiscal space was limited. But now that it is wider, the government now can afford these items,” he told the Inquirer yesterday.

    He said hiring enough support staff in schools was important to ease the burden of teachers in handling other tasks aside from teaching.

    In the previous years, teachers have been forced to juggle administrative jobs and their teaching duties due to lack of personnel, he said.

    “In the past, they do bookkeeping. When they are not teaching, our teachers also do non-teaching functions. We are now trying to correct that situation,” said Mateo.

    The DepEd has also apportioned P15.5 billion of its 2017 budget for the hiring of more than 53,800 teachers, mostly for the SHS program, and P65.4 billion for classrooms and school buildings, said Mateo.

    DepEd local chiefs can now punish school heads misusing feeding funds

    MANILA — Education Secretary Leonor Briones has given regional directors and school division officials the power to sanction school heads violating rules on the management of funds to implement this year’s school-based feeding program (SBFP).

    The SBFP aims to provide supplemental feeding to roughly two million malnourished students.

    In an order, Briones also authorized regional directors to decide whether to release the funds to school division offices (SDOs) currently implementing the SBFP or those with unliquidated funds and to determine the amount to be released to the SDOs depending on their utilization of the budget.

    “Similarly, the SDOs shall have the prerogative to decide whether or not to release the funds to schools with ongoing implementation and/or unliquidated funds for school year 2015-2016,” stated Briones.

    Briones said these provisions were added to the existing guidelines “to ensure an efficient and effective implementation of the SBFP for school year 2016-2017.”

    Another provision introduced to the guidelines states that the hiring of a cook shall be one per 40 beneficiaries subject to the availability of funds.

    For this year, the Department of Education has earmarked over P4.1 billion for the nationwide roll-out of the SBFP, providing P2,160 for the feeding and operational costs of each beneficiary for a period of 120 days or P18 a day for each beneficiary.

    This year’s SBFP aims to nourish and inculcate positive health values and habits on 533,425 severely wasted and 1.39 million wasted kindergarten to Grade 6 students in all public schools nationwide. It also aims to increase school attendance by 85 percent.

    The World Health Organization has described wasting as low weight-for-height, which is often linked with acute starvation or severe disease.

    The DepEd has noted that the Southern Tagalog region, which includes the provinces of Cavite, Batangas, Rizal, Quezon and Laguna, has registered the highest number of severely wasted and wasted public school students at more than 352,000, followed by Western Visayas with over 193,000 and Central Luzon with over 169,000.

    EO on nationwide smoking ban out this month

    An executive order (EO) that will impose a nationwide smoking ban is expected to be signed this month.

    “The president will already sign that EO. Probably within October,” Health Secretary Pauline Jean Ubial disclosed, referring to EO they have drafted that will prohibit smoking across the country.
    Ubial noted that the draft EO essentially replicates the existing ordinance in Davao City implemented since the time of Duterte as a mayor.
    “What is being done in Davao is set to be done nationwide,” the DOH chief stressed.
    Under this, all public places will be 100 percent smoke-free, she further noted.
    “There will be nobody smoking in public places anymore, whether indoor or outdoor. Parks, bus stations, and even in vehicles. All these are considered public places,” the health secretary added.
    Ubial also said they will make a strong push for Congress to amend the existing Tobacco Regulation Act of 2003 (Republic Act 9211) to be able to eliminate other contentious tobacco control policies.
    “We are still trying to explore amending the law, RA 9211 because of the many contentious issues and gray areas,” she stated, saying that among the gray areas are the point-of-sale advertisements as well as in the designation of smoking areas.
