Castro: Rechannel PBB funds to salary increases

Due to the Performance-Based Bonus (PBB) scheme’s divisive and discriminatory character, Rep. Castro urged the rechanneling of 16.7B PBB funds to salary increase during the Development Budget Coordinating Committee (DBCC) presentation of the 2017 Budget on Monday.
ACT Teachers Party-List had so long decried the divisive, deceptive and discriminatory character of this system which purports to improve efficiency of government agencies’ functions. “This system creates an atmosphere of competition among employees instead of harmonious cooperation towards providing quality public service to the people,” Castro said.
Due to the lawmakers’ incessant prodding at the new administration’s decision to continue and even increase the PBB funds, DBM Undersecretary Laura Pascua agreed to give reports assessing PBB’s role in improving the efficiency of government agencies and agreed to review guidelines in granting PBB.
Moreover, Castro explained that PBB discriminates rank-and-file government employees because the amount of bonus for each employee depend on his/her salary.
“The PBB scheme is especially unfair to the public school teachers since the criteria used to measure their performance are the NAT scores of the school, drop-out rate, and liquidation capability and expenditure of the schools’ MOOE. Such parameters do not center on evaluating the quality of teacher factor,” Castro ended.
The PBB is part of ex-DBM Sec. Abad’s Performance-Based Incentive System [PBIS] along with PEI, established through EO No. 80, s. 2012 which adopted the Results-Based Performance Monitoring System (RBPMS)—a major governance reform that puts premium in the improvement of the performance management. The previous administration had allotted huge amount of funds to this scheme (14.6B in 2015 and 13.5B for 2016).

Duterte favors postponement of barangay, SK polls

President Rodrigo Duterte on Friday said he is in favor of postponing the barangay and Sangguniang Kabataan (SK) elections scheduled later this year, noting the possibility of "drug money" being used to fund campaigns.

"Do you know the reason why I also agreed with some congressmen to postpone the barangay elections? Do you know why? Because I am afraid that the drug money will seep into the electoral process," Duterte told officers and men of the military's Eastern Mindanao Command during the command's 10th anniversary rites in Panacan, Davao City.

"You will just be adding to our headache," he added. "Those that are funded by drug money will win, at kailangan mo na mag-martial law to eliminate all. Which I will never do in the first place."

He also said that the billions of pesos earmarked for the elections could be used to fund the government's campaign against the illegal drug menace, particularly the construction or improvement of drug rehabilitation centers.


Some lawmakers, including Duterte's allies in the House of Representatives, have expressed support in the postponement.

DepEd: Sexuality education to protect learners vs exploitation

To equip and empower learners in making informed choices and decisions on issues that affect their personal safety and well-being, the Department of Education (DepEd) integrates and ensures an age-appropriate, developmental, and culture-sensitive sexuality education for learners in the K to 12 Basic Education Curriculum.
 
This is in response to Republic Act 10354 or the Responsible Parenthood and Reproductive Health Law of 2012. Stated under its Section 14, the State shall provide an age- and development-appropriate reproductive health education for adolescents, which shall be taught by adequately trained teachers in the formal and non-formal educational system.
 
As early as Grade 1, learners are taught about “good touch” and “bad touch”, which helps them avoid becoming victims of other people’s unwanted behaviors.
 
“Sinasabi natin sa mga bata na may karapatan silang tumangging magpahawak sa kanilang katawan. Dapat alam ng bata yung hawak na walang malisya at may malisya,” Dr. Rosalie B. Masilang, DepEd Adolescent Reproductive Health Focal Person and Supervising Education Program Specialist said.
 
Masilang cited that children at this age are most vulnerable to abuse and exploitation, and that there are cases where the offenders are their relatives. “May mga cases kami na kung saan ang unang nangmomolestya sa mga bata ay hindi kaiba sa kanila, yung immediate family members pa nila,” she added.
 
Sexuality education can be integrated in the curriculum in two ways—natural and purposive. Learning areas where natural integration is possible are Science, Health, Araling Panlipunan, and Edukasyon sa Pagpapakatao. Purposive integration can be done in learning areas like Mathematics and Language.
 
The DepEd emphasized that discussions on sexuality education is not about the sex act, as is the common misconception, but on the science of reproduction, physical care and hygiene, correct values and the norms of interpersonal relations to avoid pre-marital sex and teenage pregnancy.
 
In Science, sexuality education topics cover the parts of the body, reproductive system, reproductive cycle, and puberty. In Health, topics include personal hygiene and reproductive health. Discussions on issues like gender and sexuality, the Reproductive Health Law, same-sex marriage, prostitution, and gender-based violence are integrated in Araling Panlipunan. Edukasyon sa Pagpapakatao covers topics about developmental tasks and actions during puberty, and families’ mission on educating and shaping the faith of the learners.
 
Furthermore, mathematical analysis and statistics, and grammar and vocabulary enhancement in Mathematics and Language classes, respectively, can be taught using data and texts on issues like teenage pregnancy, premarital sex, and sexually transmitted infections.
 
The DepEd also invests in capacitating its teachers and guidance counselors with appropriate knowledge and skills on teaching responsible parenthood, reproductive health education and life coaching, through Learning Action Cell (LAC).
 
To make this effort possible, the DepEd partnered with the Department of Health (DOH), Commission on Population (PopCom), United Nations Population Fund (UNFPA), University of the Philippines Population Institute (UPPI), and other government and non-government agencies.

REPUBLIC ACT NO. 4670 June 18, 1966
THE MAGNA CARTA FOR PUBLIC SCHOOL TEACHERS - DOWNLOAD COPY

I. DECLARATION OF POLICY COVERAGE
Sec. 1. Declaration of Policy. It is hereby declared to be the policy of this Act to promote and improve the social and economic status of public school teachers, their living and working conditions, their terms of employment and career prospects in order that they may compare favorably with existing opportunities in other walks of life, attract and retain in the teaching profession more people with the proper qualifications, it being recognized that advance in education depends on the qualifications and ability of the teaching staff and that education is an essential factor in the economic growth of the nation as a productive investment of vital importance.

Sec. 2. Title Definition. This Act shall be known as the "Magna Carta for Public School Teachers" and shall apply to all public school teachers except those in the professorial staff of state colleges and universities.

As used in this Act, the term "teacher" shall mean all persons engaged in classroom teaching, in any level of instruction, on full-time basis, including guidance counselors, school librarians, industrial arts or vocational instructors, and all other persons performing supervisory and/or administrative functions in all schools, colleges and universities operated by the Government or its political subdivisions; but shall not include school nurses, school physicians, school dentists, and other school employees.

II. RECRUITMENT AND CAREER
Sec. 3. Recruitment and Qualification. Recruitment policy with respect to the selection and appointment of teachers shall be clearly defined by the Department of Education: Providedhowever, That effective upon the approval of this Act, the following shall constitute the minimum educational qualifications for teacher-applicants:

(a) For teachers in the kindergarten and elementary grades, Bachelor's degree in Elementary Education (B.S.E.ED.);

(b) For teachers of the secondary schools, Bachelor's degree in Education or its equivalent with a major and a minor; or a Bachelor's degree in Arts or Science with at least eighteen professional units in Education.

(c) For teachers of secondary vocational and two years technical courses, Bachelor's degree in the field of specialization with at least eighteen professional units in education;
(d) For teachers of courses on the collegiate level, other than vocational, master's degree with a specific area of specialization;

Provided, further, That in the absence of applicants who possess the minimum educational qualifications as hereinabove provided, the school superintendent may appoint, under a temporary status, applicants who do not meet the minimum qualifications: Provided, further, That should teacher-applicants, whether they possess the minimum educational qualifications or not, be required to take competitive examinations, preference in making appointments shall be in the order of their respective ranks in said competitive examinations: And provided, finally, That the results of the examinations shall be made public and every applicant shall be furnished with his score and rank in said examinations.

Sec. 4. Probationary Period. When recruitment takes place after adequate training and professional preparation in any school recognized by the Government, no probationary period preceding regular appointment shall be imposed if the teacher possesses the appropriate civil service eligibility: Providedhowever, That where, due to the exigencies of the service, it is necessary to employ as teacher a person who possesses the minimum educational qualifications herein above set forth but lacks the appropriate civil service eligibility, such person shall be appointed on a provisional status and shall undergo a period of probation for not less than one year from and after the date of his provisional appointment.

Sec. 5. Tenure of Office. Stability on employment and security of tenure shall be assured the teachers as provided under existing laws.

Subject to the provisions of Section three hereof, teachers appointed on a provisional status for lack of necessary civil service eligibility shall be extended permanent appointment for the position he is holding after having rendered at least ten years of continuous, efficient and faithful service in such position.

Sec. 6. Consent for Transfer Transportation Expenses. Except for cause and as herein otherwise provided, no teacher shall be transferred without his consent from one station to another.

Where the exigencies of the service require the transfer of a teacher from one station to another, such transfer may be effected by the school superintendent who shall previously notify the teacher concerned of the transfer and the reason or reasons therefor. If the teacher believes there is no justification for the transfer, he may appeal his case to the Director of Public Schools or the Director of Vocational Education, as the case may be. Pending his appeal and the decision thereon, his transfer shall be held in abeyance: Providedhowever, That no transfers whatever shall be made three months before any local or national election.

Necessary transfer expenses of the teacher and his family shall be paid for by the Government if his transfer is finally approved.

1. The Department of Education (DepEd), through the Bureau of Education Assessment (BEA) with the assistance of schools divisions and public secondary schools personnel, shall administer the Test of English Proficiency for Teachers (TEPT) and Process Skills Test (PST) in Science and Mathematics to all Grades 7 and 8 public school teachers in Science and Mathematics by cluster from September to December 2016 on Saturdays and/or Sundays. The BEA shall provide the dates, venues, and clustering of regions.
2. The BEA’s authorized forwarder/courier shall deliver the test materials at least two weeks before the test administration, except for the schools division offices (SDOs) of the National Capital Region, where the delivery shall be five days before the test administration. The same forwarder/courier shall retrieve all the test materials one week after the conduct of the test. Hence, all SDOs are instructed to ensure that the test materials are ready for pick-up/retrieval by the authorized forwarder/courier.
3. In the conduct of the TEPT and PST, the Division Testing Coordinator (DTC) will serve as the Chief Examiner, while the Education Supervisors and Secondary School Principals as Room Examiners. The teacher-examinees shall be given one day service credit as provided in DepEd Order No. 53, s. 2003 entitled Updated Guidelines on Grant of Vacation Service Credits to Teachers.
4. Prior to the conduct of the TEPT-PST, a national conference will be held to ensure proper and standardized test administration and resolve related concerns. BEA shall inform all schools divisions of the schedule and venue.
5. Travel expenses and allowable expenses shall be charged to BEA Funds, subject to the usual accounting and auditing rules and regulations.
6. Immediate dissemination of this Memorandum is desired.

Teacher suspended over ‘illegal’ collection of fees

THE Office of the Ombudsman for the Visayas has suspended a public high school teacher in Cebu City after he was found administratively liable for collecting unauthorized fees amounting to P46,440 from his students, and displaying improper behavior while on duty.

Rico Masong Cayanan, a Cosmetology instructor of Abellana National School, was found guilty by the anti-graft office of “conduct prejudicial to the best interest of the service” and was meted a penalty of six months and one day suspension without pay.

The case stemmed from an anonymous caller who informed the Ombudsman’s office about the alleged irregular acts of Cayanan, prompting the Ombudsman’s field investigation office to conduct an investigation.

During the investigation, the 54 former students of Cayanan gave sworn statements that their teacher collected several amounts from them, supposedly for the purchase of equipment to be used for their Cosmetology subject, such as a second-hand air-conditioning unit, tarpaulin, electric fan, leatherette bed cover, handouts, foot spa machine, bed foam, plants, and paraffin wax, among others.

Cayanan allegedly acted improperly by forcing students to buy materials from him that were overpriced and not giving grades to those who have not paid the materials.

It was also found that Cayanan allegedly directed students to perform tasks not related to their subject, like washing the carpets, curtains, blankets, and water glasses, making Nestea drinks, scrubbing his feet, having his hair ironed, and buying goods for him outside of the school beyond school hours.

In his counter-affidavit, Cayanan denied the charges against him. He explained that the training facility for the course needed a beauty care spa room or laboratory with functional equipment, apparatus, tools, implements and materials such as air-conditioning units, facial steamers, electric pot, and electric stove.


He said the school did not provide these facilities and materials so he had to buy them personally and let the students use them for free.
However, the students were required to bring their own supplies and materials such as essential oils, waxes and body scrub ingredients, he added.
He claimed that the students agreed among themselves to pool their resources in order to buy equipment and tools, insisting that he did not compel the students to do it but only encouraged them to bring any equipment available in their home.
He, however, admitted that the students contributed amounts for the tools and equipment.
He further denied that he asked the students to perform unnecessary tasks.   To support his claims, he submitted affidavits of 13 students.
But the anti-graft office gave weight to the claims of the 54 students, explaining that the evidence presented by the teacher to counter the allegation was not enough.

"The positive allegations of the students as reflecting in their respective sworn statements are more convincing than the denial of respondents," she added.

Unauthorized collection of P 46K from students violation of Anti-graft law

The Office of the Visayas Ombudsman has indicted a public high school teacher in Cebu City after it found probable cause to charge the teacher for collecting unauthorized fees amounting to P46,440 from his students.

The anti-graft office said that unauthorized collection of fees by teacher Rico Masong Cayanan from the students is considered a violation of Section 3 (a) of Republic Act 3019 or the Anti-Graft and Corrupt Practices Act.

Cayanan, a Cosmetology instructor at Abellana National School, was already suspended for six months and one day without pay after anti-graft office found him administratively liable of “conduct prejudicial to the best interest of the service” for the unauthorized collection of fees along with his improper behavior.

The case stemmed from an anonymous caller’s report, informing the Ombudsman about the alleged irregular acts of Cayanan. This prompted the Ombudsman’s field office to conduct an investigation on Cayanan.

In her resolution, Graft Investigation Officer Irish Amores said that there was “manifest partiality and evident bad faith” on the part of Cayanan when he collected fees from his students on several occasions and doing so would be prohibited by a 2012 department order issued by the Department of Education.

Amores said that it was not the responsibility of the students to buy the equipment supposedly needed for the course.

Under Section 3(a) of RA 3019, the offense has three elements, namely that the accused is a public officer discharging official functions, that he must have acted with manifest partiality, evident bad faith, or inexcusable negligence, and that his action has caused undue injury to any party, including the government.

COMELEC to stop preparations for Barangay and Sangguniang Kabataan elections

MANILA, Philippines — After the House of Representatives and the Senate of the Philippines have come into agreement to move the Barangay and Sangguniang Kabataan elections to the 4th Monday of October 2017, the poll body will now stop its preparations for the said polls that was originally set on October 31, 2016.
COMELEC Chairman Andres Bautista says the latest pronouncement from Congress is a welcome development because this will set the tone for their next move.
He says the commission is now planning to resume the conduct of voters’ registration if polls is to be conducted next year.
“Let’s see (when we will conduct it). During our en banc session earlier, I had instructed our people to formulate a new timetable on the premise that the new schedule for our elections is October 2017,” Bautista said.
Bautista points out that before stopping their preparations for the supposed October polls COMELEC has used up around 50 million pesos from their 2016 budget that was alloted for the conduct of the barangay polls.
However, the poll chief says if polls will now be on October 2017 the issue will be the budget allocation for it.
COMELEC’s original budget proposal for 2017 is 4.6 billion pesos since it is not an election year originally.
But Bautista says in conducting barangay and SK polls, they are looking at an estimate of more than 6 billion pesos.
“But we still need to utilize the fund intended for next elections,” said Bautista.

    Duterte declares ‘state of lawlessness’

    President Rodrigo Duterte early Saturday declared “a state of lawlessness” or “a state of lawless violence” to counter terrorism and strengthen the campaign against illegal-drug trade.

    Speaking in a televised interview, he clarified “it’s not martial law but it would require nationwide, well-coordinated efforts of the military and the police.”

    “I have this duty to protect the country. I have this duty to keep intact the integrity of the nation,” he added.

    “There will be major checkpoints, curfews,” he said.

    Around 4 a.m. Saturday, Duterte visited the site of the explosion at the Davao City night market that had left 14 dead and 67 wounded, based on the latest police reports.


    “This is not the first time Davao has been sacrificed in the altar of violence,” he added, citing there have been terrorist acts in the past.

    He considered the incident a police matter, “not a war.”

    He said such thing happened because Davao “is not under a fascist state. “

    “Everybody can come in and out of Davao,” he said. “Davao is safe, there is no criminality here except terrorism.”

    He ordered the police and the military to conduct searches and set up checkpoints in the city.
    Asked for his message his Davao residents, he said “keep calm.”

    “The government is with you. We will protect everyone,” he said.

    Eid Al Adha on September 12; Holidays yet to be announced

    Filipinos are now waiting proclamation for Eidul Adha regular holiday declaration.

    The Malacañang Palace is expected to announce soon the proclamation declaring Monday, September 12, 2016 a regular holiday throughout the country for Eidul Adha or "Feast of Sacrifice." This is after the Saudi Supreme court has confirmed the date of the festival on Friday.

    In a report from Al Jazeera, the annual fest is said to start on September 12, after religious authorities in the kingdom failed to sight the Moon on September 1.

    The Eid al-Adha is Islam's holiest festival celebrated annually around the world and an official holiday in Muslim-majority countries like the Philippines.

    As mandated through Republic Act (RA) 9849 signed in 2009, the tenth day of Zhul Hijja or the twelfth month of the Islamic Calendar, is hereby declared as a national holiday for the observance of Eidul Adha.

    According to Proclamation No. 1105, s. 2015 for the nationwide holidays for 2016, the National Commission on Muslim Filipinos (NCMF) shall inform the Office of the President of the actual date of Eidul Adha on which this holiday shall fall.

    Once endorsed by NCMF, President Rodrigo Roa Duterte will release the proclamation for the national holiday declaration.

    Eid al-Adha commemorates the willingness of Abraham to sacrifice his son Ishmael as an act of obedience to God, before God then intervened, to provide him with a sheep to sacrifice instead.

    Eid’l Adha, which has been a public holiday since 2002 in the country, is one of the two greatest feasts of Islam - the other being Eid’l Fitr or the Feast of Ramadan, which was also declared as a regular holiday on July 6.

    The Revised Implementing Guidelines on the Provision of Teaching Aid and Transportation Allowances to ALS Mobile Teachers and District ALS Coordinators as stipulated in the enclosure of DO 19, s. 2013, Paragraph 2 states that:
     
         All Mobile Teachers (MTs) and District ALS Coordinators (DALSCs) are entitled to receive the teaching aid and transportation allowances. Such allowances shall be used to defray transportation expenses that they incur to reach all types of ALS learners in far-flung areas and other types of barangays. On the other hand, the teaching aid allowance is intended for purchase of supplies and/or reproduction of materials they will use in the teaching-learning process.
     

         In order to qualify and avail of this benefit, all MTs and full-time DALSCs are required to enlist at least 75 learners for Nonformal Education (i.e Basic Literacy Program or Accreditation and Equivalency Program) excluding enrolees of Informal Education or InfEd (i.e. short term courses, livelihood training, etc.). However, their InfEd learners must still be included in their list of enrolees to be considered as a value-added to the ALS implementor’s performance. Part-time DALSCs on the other hand are required to enlist at least 50 Nonformal Education learners.

    DepEd issues revised guidelines on selection of honor students

    The Department of Education has issued revised Policy Guidelines on Awards and Recognition for the k to 12 Basic Education Curriculum or guidelines on the selection of honor students in public schools in view of the new grading system they have implemented under their K (Kindergarten) to 12 Basic Education Curriculum (BEC) reform program.


    The revised guidelines now disregard the consideration of the involvement of an outstanding honor student’s in co-curricular activities.

    Effective School Year 2016-2017 the Policy Guidelines on Awards and Recognition for the K to 12 BEC shall be implemented in public elementary and secondary schools, including Grade 6 classes under the old Basic Education Curriculum (BEC).
