How to Compute Working Holiday Pay?

Pursuant to Presidential Proclamation No. 269, s. 2017 declaring the regular holidays and special non-working holidays for 2018, the Department of Labor and Employment (DOLE) issued Thursday a labor advisory prescribing the appropriate computation of holiday pay.
Labor Advisory No. 10, s. 2017 on “Payment of Wages for the Regular Holidays and Special (Non-Working) Holidays for the Year 2018,” will guide private sector employers on the list of holidays for 2018 and how wages are computed if their workers opted to report for work on such days.
Regular holidays are New Year’s Day (January 1), Maundy Thursday, Good Friday, Araw ng Kagitingan , Labor Day (May 1), Independence Day (June 12), National Heroes Day (August 27), Bonifacio Day (November 30), Christmas Day (December 25), and Rizal Day (December 30).
Also included are the observance of Eidul Fitr and Eidul Adha, the proclamations of which will be issued after the approximate dates of the Islamic Holidays have been determined in accordance with the Islamic calendar or the lunar calendar, or upon Islamic astronomical calculations.
For these holidays, work done during these days shall be paid 200% of an employee’s regular pay for the first eight hours or [(Daily Rate +COLA) x 200%]; while work done in excess of eight hours (overtime), shall be paid an additional 30% of the employee’s hourly rate or [(Hourly Rate of the basic daily wage x 200% x 130% x number of hours worked)].
Meanwhile, work done during these days that also falls on employee’s rest day shall be paid an additional 30% of his/her daily rate of 200% or [(Daily Rate + COLA) x 200%] + [30% (Daily rate x 200%)]; while for work done in excess of eight hours (overtime), shall be paid an additional 30% of his/her hourly rate, or [(Hourly Rate of the basic daily wage x 200% x 130% x 130% x number of hours worked)].
However, if the employee did not report to work during these days, he/she shall still be paid 100% of his/her salary for that day or [(Daily Rate + COLA) x 100%].
The special (non-working days), on the other hand, are Chinese New Year (February 16), EDSA Revolution Anniversary (February 25), Black Saturday (March 31), Ninoy Aquino Day (August 21), and All Saints Day (November 1). December 31, December 24 and November 2 are additional special non-working days.
The pay rules for these holidays provide that for work done, an employee shall be paid an additional 30% of his daily rate on the first eight hours or [(Daily Rate x 130%) + COLA]; while for work done in excess of eight hours (overtime), he/she shall be paid an additional 30% of his hourly rate or [(Hourly Rate of the basic daily wage x 130% x 130% x number of hours worked)].
For work done during these days that also fall on employee’s rest day, he/she shall be paid an additional 50 percent of his/her daily rate on the first eight hours, or [(Daily Rate x 150%) + COLA]; while for work done in excess of eight hours (overtime), he/she shall be paid an additional 30% of his hourly rate, or [(Hourly Rate of the basic daily wage x 150% x 130% x number of hours worked)].
But if the employee did not work, the"‘no work, no pay" principle shall apply unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on special holidays. (DOLE-PR/PNA)

Duterte pledges pay hike for public school teachers

President Duterte has pledged to raise the salaries of public school teachers this year following the recent pay hike granted to soldiers.

In his visit to Bulacan, the President invited representatives of school teachers to visit Malacañang this month to finalize an agreement on the planned salary increase.

Budget Secretary Benjamin Diokno  gave his assurance on Friday that the fourth tranche of the salary increase for government workers will be implemented by February, and that state employees will be entitled to their salary differential.

The budget chief made the statement a few days after announcing that the scheduled wage hike for government workers this year may only be implemented once the 2019 budget is passed into law.
“With pronouncements from Congress that budget bill will be their top priority upon resumption next week, we expect the GAA(General Appropriations Act) to be signed first week February,” Diokno said.
Earlier, Diokno said there would be no legal foundation for the fourth salary adjustment without the proposed 2019 general appropriations law enacted.
He told reporters that the DBP “cannot implement the scheduled hike for 2019 without legal basis, which is still pending in Congress."

According to the Budget Secretary, government workers will enjoy an additional salary hike scheduled in 2020.

The DBM said the Governance Commission For GOCCs (GCG) is contracting an independent firm to conduct a study on the wage structure of government workers vis-a-vis their private sector counterparts.

"The DBM will be utilizing this data to craft a new salary schedule for government workers to be implemented starting 2020," their press release read.

It added that the funding for the conduct of the study has already been allocated to the agency budget of the GCG for fiscal year 2019.

"Currently, the GCG is conducting Early Procurement for the independent researcher so they may proceed with the conduct of the study as soon as the 2019 General Appropriations Act is passed," the DBM said.

Malacañang has made an urgent call for Congress to pass the 2019 budget immediately, emphasizing that further delays in approval would affect the salary of state workers and hamper the implementation of government projects.

Panties for your vote? Comelec says underwear OK as campaign material

Using panties as campaign material is essentially allowed as the Philippines’ election laws do not differentiate on articles of clothing that may be used as campaign material, an official from Commission on Elections said on Friday.

Comelec Spokesperson James Jimenez explained that a pair of panties is not so different from t-shirts or caps that are usually used as campaign giveaways.

If you think about it, walang pinag-iba ang panty sa cap o sa t-shirt, right (the panty is no different from a t-shirt or cap, right)? It is an article of clothing,” Jimenez said in a press conference.

“Ultimately, as far as the law is concerned, there doesn’t seem to be any sort of fundamental reason for making it more unacceptable than say, a printed t-shirt,” he added.

Jimenez made the remark in light of a viral post on social media showing a panty bearing the name of a local politician used as a campaign giveaway.

Asked if a panty would be allowed as campaign material, Jimenez answered in the affirmative.

“Pwede naman (can be),” he said.

The poll body’s spokesman said that politicians are becoming more innovative with their campaign strategies this coming election.

“I think 2019 is the year of innovative campaign strategies for sure,” he said.

However, not all of these innovative campaign strategies turn out to be beneficial.

“Yung psychology ng panty (The psychology of the panty), it’s funny, and look at how much air (time) he is getting. Look at how much coverage this whole thing is getting,” he said.

“But it’s a double edged sword kasi mapag-uusapan ka pero anong uri ng pag-uusap ang ikakabit sa pangalan mo, diba?” he added.

(But it’s a double-edged sword because people will talk about it, but what kind of conversation would you want your name to be associated with?)

Earlier, Comelec Commissioner Rowena Guanzon reacted to the panty giveaway, saying that there should be a rule on what campaign materials should be prohibited.

“We should have a rule on what materials are prohibited. Those that are obscene or show women as sex objects,” Guanzon earlier said.

Jimenez reminded the public that though the election period starts on Sunday, Jan. 11, campaigning is still not allowed until Feb. 12 for senatorial candidates and party-list groups and March 30 for those seeking a seat at the House of Representatives and local government units. /ee

Revised SALN Form (Statement of Assets, Liabilities and Net Worth)

What is the SALN?

It is the statement of assets, liabilities and net worth, and the disclosure of financial connections or business interests and identification of relatives within the fourth degree of consanguinity or affinity. Further, it also requires the declarant to name his/her bilas, balae and inso who are in government service.

What is the purpose of the SALN?

To enjoin all public officers and employees to declare and submit an annual true, detailed and sworn statement of their assets, liabilities and net worth, including disclosure of business interests and financial connections, and to declare to the best of their knowledge their relatives in the government service.

Who are required to file the SALN?

All officials and employees of government are required to file the SALN. The government pertains to the national and local governments, including state universities and colleges, and government owned and controlled corporations (GOCC) and their subsidiaries, with or without original charter.

Who are exempted from filing the SALN Form?

1) Those serving in honorary capacity - persons who are working in the government without service credit and without pay.
2) Those whose position title is laborer - persons whose work depends on mere physical power to perform ordinary manual labor, and not one engaged in services consisting mainly of work requiring mental skill or business capacity, and involving the exercise of intellectual faculties.
3) Those who are casual or temporary workers - persons hired to do work outside what is considered necessary for the usual operations of the employer's business.

What law governs the filing of the SALN Form?

Republic Act No. 6713 otherwise known as the Code of Conduct and Ethical Standards for Public Officials and Employees

What form should be used?

The currently prescribed form is the one revised as of January 2015 per CSC Resolution No. 1500088 promulgated on January 23, 2015.

When must a SALN be filed? 

“within thirty (30) days after assumption of office;
“on or before April 30 2 , of every year thereafter; and
“within thirty (30) days after separation from the service.“

DepEd announces expected salary increase of public school teachers in 2019


The Department of Education (DepEd) has announced the expected salary increase of public school teachers for 2019.


A total of 913,083 public school teachers are expected to receive a salary increase for the final tranche of the Salary Standardization Law (SSL).

Following Executive Order No. 201 or the “MODIFYING THE SALARY SCHEDULE FOR CIVILIAN GOVERNMENT PERSONNEL AND AUTHORIZING THE GRANT OF ADDITIONAL BENEFITS FOR BOTH CIVILIAN AND MILITARY AND UNIFORMED PERSONNEL,” the 2016 Salary Standardization Law was prescribed for civilian and uniformed personnel.

Under the SSL, government personnel including teachers under DepEd will be entitled to salary increase given in four (4) tranches starting January 1, 2016. After the 1st, 2nd and 3rd tranches, public school teachers should be receiving their 4th tranche of salary increase effective January 1, 2019.

Delay in release of wage hike 

Sevilla announced that there is a delay in the releasing of teachers’ wage hike due to Congress’ failure to approve the 2019 national budget.

Sevilla explained, “2019 is the last year of the tranches, nun pong increase na na-approve during the time of President Benigno Aquino and dahil last na po ito, hindi naman po kasama 'yan sa 2018 budget at pag nag-reenact tayo ng 2018 [budget], wala 'yung provision ng fourth tranche.”

The undersecretary said that they will have to wait until the General Appropriations Act of 2019 gets the nod of approval, most likely before March.

SC is asked to compel DBM to release 4th tranche of salary hikes for government workers


The Supreme Court (SC) on Monday was asked to compel the Department of Budget and Management (DBM) to release starting Tuesday the P42.7 billion representing the fourth tranche of salary increases for government workers.

The fourth tranche of salary increases is provided for under Executive Order No. 201 that was issued by former President Benigno Aquino III in 2016.

In a petition filed by House Majority Leader Rolando Andaya Jr., the SC was told that the release of the funds for the increases should be a ministerial duty of the DBM.

Together with a group of 50 government personnel, Andaya’s petition stated that the DBM should release the funds even while the government is using a re-enacted budget for failure of Congress to pass the 2019 General Appropriations Act (GAA), the budget law.

“There is no basis for the delay in the release and disbursement of funds as there are available alternative sources of funds for the fourth tranche of personnel benefits under EO 201,” the petitioners said.

PASIG CITY, January 15, 2019– As the election period officially opens, Department of Education (DepEd) Secretary Leonor Magtolis Briones cautioned all officials, teaching and non-teaching personnel of the agency against electioneering and engaging in any partisan political activity, and reminded them to strictly observe the periods of certain prohibited acts in connection with the 2019 mid-term polls.

“The Constitution mandates that no officer or employee in the civil service shall engage, directly or indirectly, in any electioneering or partisan political campaign. The same applies to our officials, teachers, and employees. DepEd must maintain its focus on non-partisan public service and remain a beacon of integrity in these times,” Briones noted.

DepEd Order No. 48, series 2018 identified activities regarded as partisan political activities, in accordance with existing rules and regulations promulgated by the Civil Service Commission (CSC) and the Commission on Elections (Comelec). The prohibited activities include but are not limited to:
• Forming organizations, associations, clubs, committees, or other groups of persons for the purpose of soliciting votes and/or undertaking any campaign for or against a candidate/party;
• Making speeches, announcements, or commentaries, or holding interviews for or against the election of any candidate or party for public office;
• Publishing, displaying, or distributing campaign literature, or materials designed to support or oppose the election of any candidate or party;
• Receiving any contributions for political purposes, either directly or indirectly;
• Wearing of t-shirts or pins, caps or any other similar election paraphernalia bearing the names of the candidates or political party except as authorized by Comelec;
• Being a watcher for a political party or candidate during the election;
• Utilizing government resources such as personnel, including job order or contract of service hires, time, and properties for political purposes

DepEd officials are also prohibited from using their position of authority to influence teaching and/or non-teaching personnel under their supervision of jurisdiction to support any preferred candidate or political party.

Meanwhile, DepEd Memorandum No. 199, series 2018 provided guidance for all officials and personnel on the Comelec resolutions that prescribe a calendar of activities and periods of prohibited acts beginning May 13, 2018 until August 11, 2019 in connection with the 2019 national and local polls.

The Education chief circulated the two issuances as early as November and December in 2018, respectively, to ensure the proper information and strict compliance of all its officials and personnel. Any DepEd official or personnel who commits any of the prohibited acts shall be dealt with in accordance with DepEd Order No. 49, series 2006 (Revised Rules of Procedure of the Department of Education in Administrative Cases), the Revised Rules on Administrative Cases in the Civil Service, and the Omnibus Election Code.

As per CSC ACT and Deped meeting represented by Usec. Mateo and Usec. Catibog, CSC-DepEd-ACT tripartite meeting @ the House of Representatives, January 10, 2019. PBB status are as follows:

Region III: some divisions were already released
Region IV-A and NCR: already endorsed to DBM ROs for processing of funds then to the divisions, after which the funds will be released to the teachers.

Diokno releases 4th tranche of salary hike but only for LGU and GOCC personnel

Budget Secretary Benjamin Diokno has allowed the release of the fourth tranche of salary increase but only for employees of local government units (LGU) and government-owned and -controlled corporation (GOCC).

House Majority Leader Rolando Andaya Jr. said Friday he got hold of two circulars of the Department of Budget and Management (DBM) authorizing LGUs and GOCCs to release the fourth tranche of the wage hike to their employees under the Salary Standardization Law.

Local Budget Circular No. 118 and Corporate Budget Circular No. 23 were both signed by Diokno on January 15 and took effect on January 1.

Local Budget Circular No. 118 states the amounts required to implement the salary adjustments of LGU personnel shall be sourced exclusively from LGU funds.

Meanwhile, Corporate Budget Circular No. 23 states the amounts required to implement the compensation adjustment shall be charged against their approved corporate operating budgets, provided that the national government shall not release funds for compensation adjustment and the GOCC shall not resort to borrowings for the purpose.
